How much does a real estate lawyer cost in Ontario?
Residential real estate closing costs in Ontario generally include (i) legal fees, (ii) title insurance, (iii) Land Transfer Tax (both Ontario and — for Toronto properties — the Municipal Land Transfer Tax), (iv) Teranet registration fees, and (v) HST on legal fees. Do I need a lawyer to close a real estate transaction in Ontario?
Yes. In Ontario, only a lawyer licensed in the province may conduct electronic registration of a transfer or charge through the Teraview system. How do I make a legally valid will in Ontario?
To be valid, an Ontario will must generally be in writing, signed at its end by the testator, and witnessed by two individuals who are present with the testator at the same time. A holograph will — wholly in the testator's own handwriting and signed by the testator — is also recognized. Do I need a foreign divorce opinion letter to remarry in Ontario?
Yes, in most cases. If you were divorced outside Canada and wish to remarry in Ontario, the Office of the Registrar General will require a foreign divorce opinion letter prepared by an Ontario lawyer before a marriage licence can be issued. The letter confirms that your foreign divorce is recognized under Canadian law, based on the test in section 22(1) of the Divorce Act (at least one former spouse habitually resident in the granting jurisdiction for at least one year preceding the divorce) or the common-law doctrine of real and substantial connection. To prepare the letter, we need the original or court-certified divorce decree, a certified translation if it is not in English or French, a copy of your Ontario marriage licence application, and a brief statement of residence. Can I transfer a vehicle from an estate in Ontario if there is no will?
Often yes, and often without the cost of a full probate application. When a family member dies without a will, the Ontario Ministry of Transportation (through ServiceOntario) will frequently accept a lawyer's opinion letter in place of a Certificate of Appointment of Estate Trustee to authorize the transfer of a vehicle to a surviving family member. The letter identifies the deceased, confirms the intestacy, and sets out the applicant's entitlement under Part II of the Succession Law Reform Act. Avion Law offers these opinion letters as a flat-fee service. To prepare one, we need the death certificate, the vehicle ownership document, identification of the family member receiving the vehicle, and a brief summary of the family composition. What is the limitation period for a civil claim in Ontario?
The basic limitation period in Ontario is two years from the day the claim was discovered, with an ultimate limitation period of fifteen years from the day the act or omission took place. Certain claims — including those arising from domestic violence, sexual assault, and specific statutory proceedings — are subject to different or no limitation periods.
